Terms of Service

To register a DorHob account or use DorHob services, you must read and comply with the DorHob Terms of Service (hereinafter referred to as "these Terms"). The terms "DorHob" and "we" in these Terms refer to the applicable DorHob contracting parties (as defined in Section 4 below).

DorHob provides a variety of products and services under these Terms to help you build your own online store (hereinafter referred to as "Online Services") to sell your products or services to customers. These products and services are collectively referred to as "DorHob Services" in these Terms. Any new features or tools added to the DorHob Services shall be subject to these Terms. We may update the content of these Terms at any time. DorHob reserves the right to modify and update these Terms by publishing updates and changes on the DorHob website. It is recommended that you check these Terms of Service periodically to understand any updates or changes that may affect you. If you do not accept updates or modifications to the Terms, please immediately stop using the DorHob Services.

Before registering a DorHob account or using DorHob, you must read, agree to, and accept all the terms and conditions contained in these Terms of Service, including the User Agreement , Privacy Policy , API License and Use Terms (hereinafter referred to as the API Terms), and the Data Processing Appendix . If you sell Covid-19 related products, you must also read, agree to, and comply with the rules for selling Covid-19 related products .

 

  1. Account Terms

To access and use DorHob services, you must provide a valid full name, current address, phone number, valid email address, and any other required information when registering a DorHob account. DorHob may refuse your account application or cancel an existing account for any reason.

You must be 18 years of age or older, or at least of the legal age of majority in the place where you reside or use the Service (“Location of Operation”).

You confirm that you are using DorHob services for business purposes, and not for personal or family reasons.

You represent and accept that the email address you provided when registering your account or subsequently updated is the primary means of communication between you and DorHob. You should check this email address regularly and ensure it can send and receive emails. Your email communications with DorHob are only considered to originate from you if they come from your primary account email address.

You are responsible for ensuring the security of your account password. DorHob assumes no responsibility for any loss or damage caused by your failure to secure your account password due to your own reasons.

You agree not to bypass, circumvent, or circumvent any technical limitations of the Service, including not processing orders outside of DorHob' checkout system, not using any tools to enable other disabled features or functions in the Service, or decompiling, disassembling, or otherwise reverse engineering the Service.

You agree not to use any robots, search engine spiders, crawlers, or other automated means to access or monitor any content or information on the Service.

You acknowledge that you are responsible for the creation and operation of your store.

DorHob is not an online retail platform (marketplace). Transactions generated by your store through DorHob technology are direct transactions between you and third parties and are unrelated to DorHob.

You are responsible for all activities on your account and for all materials (including photographs, images, videos, graphics, written content, audio files, code, information, or data) that you upload, collect, generate, store, display, distribute, transmit, or exhibit.

If you violate or breach any provision of these Terms of Service (including the User Agreement ) (which DorHob will determine in its sole discretion), your service may be terminated immediately.

 

  1. Account Activation

  • 1.1 Shop Owner
    • 1.1.1 Pursuant to Section 1.1.2, for the purposes of these Terms, the person registering for the Services will be the Contracting Party (“Shop Owner”) and will be authorized to use the relevant services we provide to the Shop Owner. You are responsible for ensuring that the Shop Owner’s name (including the legal name of the company to which the shop belongs, if applicable) is clearly displayed on the shop’s website.
    • 1.1.2 If you are registering for the service on behalf of your employer, your employer must be the store owner. If you are registering for the service on behalf of your employer, you must use the email address provided by your employer, and you represent and warrant that you have been authorized to bind your employer to these Terms of Service.
    • 1.1.3 Your DorHob store can only be associated with one store owner. A store owner can have multiple DorHob stores. A "store" refers to an online store or physical retail location associated with an account.
  • 1.2 Employee Accounts
    • 1.2.1 Depending on your DorHob subscription plan, you can create one or more employee accounts (“Employee Accounts”) to allow other people to access the account. Store owners can set permissions and determine the access level of employee accounts to specific business information (for example, you can set employee accounts to restrict access to sales information on the “Reports” page, or prohibit employee accounts from changing general store settings).
    • 1.2.2 The store owner shall be responsible for all consequences arising from the use of an employee account in fulfilling the obligations set forth in these Terms of Service, and such consequences shall be deemed to be the result of the store owner's own actions.
    • 1.2.3 Both store owners and users under "employee accounts" are referred to as "DorHob users".

 

  1. Checkout account

After completing the service registration, DorHob will offer merchants a variety of payment service providers to choose from. You can select the channel through which to collect payments from customers.

You are responsible for registering, activating, and maintaining your receiving accounts. If you no longer need these accounts to remain active, you must close them yourself. For the avoidance of ambiguity, payment service providers are third-party services, as defined in Section 15 of these Terms and Conditions.

By using a payment account in your store, you agree to be bound by the terms and conditions of the relevant payment service provider, which may revise these terms and conditions from time to time. Such revisions are effective from the date of publication. If you continue to use the payment account in your store after the revised terms are published, you agree to and accept the revised terms. If you do not agree to any changes made to the terms by the payment service provider, please close your payment account and stop using the corresponding payment service in your store.

If you use the Quick Launch service, the Quick Launch agreement terms will apply.

 

  1. General Terms and Conditions

Before you become a DorHob member, you must read, agree to, and accept all the terms and conditions contained in these Terms of Service, including the User Agreement and Privacy Policy . Additionally, if you sell related items, you must accept and agree to be bound by the rules governing the sale of COVID-19 related products .

Technical support for DorHob services is only available to DorHob users.

These Terms of Service are governed by and construed in accordance with the laws of China, excluding any conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms of Service and is therefore expressly excluded.

You acknowledge and agree that DorHob may modify these Terms of Service by posting a revised or restated version of these Terms of Service at https://www.DorHob.com/pages/terms . The revised version of these Terms of Service will become effective on the effective date following a seven (7) day public comment period beginning with the date of this update. Your failure to object during the public comment period or your continued use of our services after the effective date constitutes your agreement to and acceptance of these revised Terms of Service. If you do not agree to any changes to these Terms of Service, please do not continue to use our services.

You may not use the DorHob service for any illegal or unauthorized purpose, nor may you violate any laws (including but not limited to copyright law) of the location where you operate, any laws and regulations applicable to the location of your customers, or any laws and regulations of China when using this service. You will comply with all applicable laws, regulations, rules, and these Terms of Service when using this service.

Your access to and use of the DorHob API (as defined in the API Terms and Conditions) is governed by the API License and Terms of Use. You are solely responsible for your actions regarding the use of your API certificate (as defined in the API Terms and Conditions) and for ensuring the security of your API certificate.

Without DorHob’s written permission, you may not reproduce, copy, sell, resell, or profit from any part of the Service, use of the Service, or access to the Service.

You may not purchase domain names and search engine or other pay-per-click keywords (such as Google Ads) that use the DorHob trademark, its variations or misspellings.

You acknowledge that your information (excluding credit card information) may be transferred unencrypted and involves (a) transmission over various networks; and (b) changes made to comply with and adapt to the technical requirements of connected networks or devices. Credit card information is always encrypted during network transmission.

You acknowledge and agree that your use of DorHob services, including information transmitted to or stored by DorHob, is protected and governed by this Privacy Policy .

These Terms and Conditions may be available in versions other than English. In the event of any discrepancy or conflict between different language versions of these Terms and Conditions, the latest English version shall prevail. Unless DorHob decides otherwise (at its sole discretion) or applicable law requires, all disputes arising from these Terms and Conditions shall be resolved in English.

All terms and conditions of these Terms of Service are binding on and in the interest of both parties to these Terms of Service and their respective successors, successors, authorized assigns and legal representatives. DorHob has the right to assign these Terms of Service without notice to you or without your consent. You have no right to assign or otherwise delegate these Terms of Service or any of your rights or obligations under this Agreement to any third party without DorHob's prior written consent.

If any or any part of these Terms of Service is invalid or unenforceable for any reason , that part or all of it will be invalid or unenforceable, but will not affect any other terms. These Terms of Service will be deemed not to cover such invalid or unenforceable terms.

Sections 1, 2-5 of Part 3, 4, 6-8, 12-13, 6-8 of Section 15, 17, 19 and 20 of these Terms shall continue to be in force or effect upon termination or expiration of these Terms.

 

  1. DorHob contracting parties

If your store's billing address is located in the United States, Canada, or the European Union (a member state of the European Union), then this section 4.1 applies to you:

"DorHob Contracting Party" refers to DorHob Inc., a Fintech company with its business address at Ghana Railway Land, Guggisberg Road, Adum-Kumasi, Ghana-West Africa.

For any dispute or claim arising out of or relating to these Terms of Service, both parties shall irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Ontario. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms of Service and is therefore expressly excluded.

If your store's billing address is located in the Asia Pacific region (including Australia, New Zealand, China, Japan, and Singapore), the Middle East and Africa region, or any region other than those specified in Section 4.1, including Russia, South America, the Caribbean, or Mexico, then this Section 4.2 applies to you:

"DorHob Contracting Party" refers to Metenant Business Centre, a Fintech company with its business address at Ghana Railway Land, Guggisberg Road, Adum-Kumasi, Ghana-West Africa.

For any dispute or claim arising out of or relating to these Terms of Service, both parties shall irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Hong Kong. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms of Service and is therefore expressly excluded.

 

  1. DorHob Rights

We reserve the right to modify or terminate this service at any time for any reason without prior notice. Not all services and features are available in every jurisdiction, and we have no obligation to provide any service or feature in any jurisdiction.

We reserve the right to refuse to provide services to anyone at any time.

If we determine that a store's products or services or materials posted on the store violate DorHob's Terms of Use or these Terms of Service, we have the right, but not the obligation, to remove the materials and suspend or terminate the account.

Any verbal or written abuse (including insults or threats of retaliation) against DorHob customers, DorHob employees, members, or staff will result in immediate account termination.

DorHob does not pre-screen submissions; we can decide for ourselves to reject or delete any submissions in the service.

We reserve the right to provide services to your competitors and do not undertake exclusivity in any particular market segment. You further acknowledge and agree that DorHob partners or employees may also be DorHob customers or merchants who may compete with you, but they cannot use your confidential information.

If there is a dispute regarding account ownership, we reserve the right to request proof of account ownership. Such documents may include, but are not limited to, a scanned copy of your business license, government-registered identification, the last four digits of your credit card, proof of employment, etc.

We have the right to determine the legitimate ownership of an account and, at our sole discretion, to transfer the account to the rightful owner. If we are unable to determine the rightful owner of the account, DorHob reserves the right to temporarily disable the account until the parties to the dispute reach a solution, without prejudice to any other rights and remedies available to DorHob.

 

  1. Confidentiality

"Confidential Information" should include, but is not limited to, any and all information related to the business of the parties involved that is not publicly disclosed, including specific business information, technical processes and formulas, software, customer lists, prospective customer lists, names, addresses and other information about customers and prospects, product designs, sales figures, costs (including any associated processing fees), price lists and other unpublished financial information, business plans and marketing data, and any other confidential and proprietary information, whether or not marked as confidential or proprietary. DorHob' confidential information includes all information you receive that is not yet publicly known in relation to us or our services, including information about our security plans or practices.

Both parties agree to use each other's confidential information only to the extent permitted by and in accordance with the obligations set forth in these Terms of Service and other obligations set forth in these Terms of Service. Each party agrees that it shall take all reasonable steps, at least equivalent to those measures a party would take to protect its own confidential information, to prevent the copying, disclosure, or use of any such confidential information, and (i) its employees, agents, and subcontractors, and their employees, who must access such information, shall comply with this confidentiality obligation; and (ii) where permitted by law, in the event of disclosure of such information pursuant to applicable laws or court orders, the receiving party shall promptly give written notice to the disclosing party and make commercially reasonable efforts to ensure that such disclosure is handled confidentially. Confidential information shall not include information that the receiving party can prove to be: (A) already in the public domain, or already known or possessed by the receiving party at the time of disclosure; (B) independently developed by the receiving party without using or referencing the other party's confidential information, and without violating any provision of these Terms of Service; or (C) subsequently correctly obtained by the receiving party from a source other than the disclosing party, and that source does not violate any provision of these Terms of Service.

 

  1. Limitation of Liability

You expressly understand and agree that, to the extent permitted by law, DorHob shall not be liable for any direct, indirect, incidental, special, accessory, or punitive damages arising from the use of or inability to use the DorHob services, including but not limited to loss of revenue, goodwill, data, or other intangible assets resulting from the use of or inability to use the services.

To the extent permitted by law, in no event shall DorHob and its suppliers be liable for loss of profits or any special, incidental, or consequential damages arising out of or related to our website, services, or these Terms of Service (including those arising from negligence). You shall indemnify and hold harmless DorHob and its affiliates, partners, officers, directors, agents, employees, and suppliers from and against any claims arising out of or relating to your breach of these Terms of Service or other ancillary documents (including the User Agreement ), or your violation of any law or the rights of any third party, and agree to indemnify us for any related legal costs and damages, including reasonable attorneys' fees.

You use this service at your own risk. The service is provided to you on an "as is" and "as available" basis without any express, implied or statutory warranties or conditions.

DorHob does not guarantee that this service will be timely, secure, error-free, or uninterrupted.

DorHob does not guarantee that the results obtained through using this service are accurate or reliable.

DorHob is not responsible for any tax or fee obligations you incur as a result of using DorHob services.

DorHob does not guarantee that the quality of any products, services, information or other materials you purchase or obtain through the "Service" will meet your expectations, or that any errors in the "Service" will be corrected.

 

  1. Waivers, divisibility, and completeness of the agreement

DorHob's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms (including all provisions and other documents incorporated herein by reference) is held invalid, illegal, or unenforceable by a court of competent jurisdiction, DorHob shall amend and interpret such provision to replace such invalid, illegal, or unenforceable provision to the fullest extent permitted by law, and the economic effect of such valid provision shall be as similar as possible to that of the invalid, illegal, or unenforceable provision, and the validity, legality, or enforceability of the remaining provisions of these Terms shall not be affected or impaired in any way.

These Terms of Service (including other documents incorporated herein by reference) constitute the entire agreement between you and DorHob, binding you on your use of the Services and your account, and supersede any prior agreements between you and DorHob (including, but not limited to, any previous versions of these Terms of Service).

 

  1. Intellectual Property and Customer Content

We will not claim any intellectual property rights to the materials you provide to DorHob. You retain the intellectual property rights to all materials you provide to DorHob. All materials you upload belong to you. You can delete your account and thus your DorHob store at any time.

When uploading materials, you agree to: (a) allow other internet users to view the materials you publicly post to your store; (b) allow DorHob to store, display and use your materials (for the materials you publicly post); and (c) DorHob may inspect and delete any materials you submit to its services at any time, but DorHob has no obligation to do so.

You retain ownership of all materials you upload to your DorHob store; however, to make your store public, you agree to allow others to view the materials you publicly post to your store. You are responsible for ensuring that these materials comply with any applicable laws or regulations.

DorHob has the non-exclusive right and license to use your store’s name, registered trademarks, service marks and brand logo to market DorHob services.

 

  1. Shipping

For items sold in your DorHob store, you can purchase shipping labels from DorHob' third-party service providers when shipping.

 

  1. Theme Store

You can use design templates from the DorHob Theme Store (“Theme Templates”) to design the appearance of your DorHob store. If you download a theme template, you can only use it for a single store. If you close a store, you can transfer the template to your second store. To transfer a template to your other store, please contact DorHob Support. You may not transfer or sell the template to any other person's store on DorHob or any other platform. Multiple stores may require multiple downloads, each at a cost. DorHob does not guarantee that a particular template will be available for multiple downloads. You can choose to modify the theme template to suit your store. DorHob may add or modify footers used to reference DorHob at its discretion. DorHob may also, at its sole discretion, modify content that violates the DorHob User Agreement or Terms of Service , even if you have received such a template. DorHob may modify theme templates as needed to reflect technology changes and updates.

The intellectual property rights of the theme template remain with the designer. If you exceed the rights permitted by the theme purchase, the designer may take legal action against you. Without affecting other rights and remedies, DorHob may take administrative measures, such as modifying or closing your store.

Technical support for theme templates is the responsibility of their designers. DorHob is not responsible for providing such support, but DorHob can help you contact the designers.

It is the user's responsibility to ensure that the installed new template does not overwrite or damage the user's current or pre-saved theme or user interface; DorHob assumes no responsibility for any loss or damage.

 

  1. Payment of Fees

You will need to pay a subscription fee for the online service (hereinafter referred to as the "Subscription Fee") and any other applicable fees, including but not limited to fees applicable to sales generated by your store using the payment service (hereinafter referred to as the "Transaction Fee"), and any fees incurred from your purchase or use of any products or services (such as applications, theme templates, domain names, DTC services, or third-party services) (hereinafter referred to as the "Additional Fees"). The Subscription Fee, Transaction Fee, and Additional Fees are collectively referred to as the "Fees".

You must keep a valid credit card on file to pay all incurred fees. DorHob will charge applicable fees to your authorized credit card account (hereinafter referred to as the "Authorized Card") and will continue to charge applicable fees to the Authorized Card (or any alternative card) until the service is terminated and all outstanding fees are paid in full. Unless otherwise stated, all fees and other charges are denominated in US dollars, and all payments are received in US dollars.

Subscription fees are payable in advance and will be billed on 30-day intervals, starting at 23:59:59 on the trial/subscription expiration date (“Initial Charge”). DorHob will charge you the subscription fee on each billing date. Transaction fees and surcharges will be charged at DorHob’s sole discretion.

The fee will be displayed on the bill and sent to the account owner via the provided email address. The bill will also appear on your account page in your DorHob admin panel.

If we are unable to collect the subscription fee from the authorized card, we will send a reminder to the account owner via the provided email to renew the credit card. We will attempt to charge the authorized card again every 24 hours, up to a maximum of three charging attempts (including the first attempt). After the third unsuccessful attempt, we may suspend and revoke access to your account. Your account will be reactivated after you pay all outstanding fees and the usage fee for the next billing cycle. During the account suspension period, you will not have access to your account.

If we are unable to charge the authorized card for the transaction, we will send a reminder to the account owner via email to renew the credit card. We will attempt to charge the authorized card again every 24 hours, up to a maximum of four attempts (including the initial attempt). Your store can continue to operate normally after the first failed attempt; after the second and third failed attempts, your store can continue to operate but the admin panel will be frozen; after the fourth or third failed attempt, we may suspend and revoke access to your account. Your account will be reactivated after you pay all outstanding fees and the usage fee for the next billing cycle. During the account suspension period, you will not be able to access your account.

DorHob reserves the right to terminate your account if the outstanding fees are not paid within 60 days from the date of suspension.

All fees exclude any applicable taxes, fees or charges levied by the government (hereinafter referred to as "taxes").

You are responsible for paying all applicable taxes incurred from your subscription to or purchase of DorHob products and services. To the extent that DorHob charges these taxes, they are calculated based on the applicable tax rate for the billing address you provide to us. These fees are additional charges beyond the cost of these products and services and will be collected from your authorized card. If you are eligible for exemption from these taxes, you must provide us with proof of your exemption, which in some jurisdictions includes original certificates demonstrating your eligibility for exemption and compliance with applicable laws. Exemption applies only from the date DorHob receives the qualifying proof of exemption. If DorHob does not charge you any taxes, you are responsible for determining whether taxes are payable and, if so, paying them yourself to the appropriate tax authority in your jurisdiction.

For the avoidance of doubt, all payments due to you to DorHob under these Terms of Service shall be paid in full, without any deductions or withholdings. Apart from taxes collected by DorHob from you and remitted on your behalf to the relevant tax authorities, any legally required deductions or withholdings shall be borne by you and paid separately to the relevant tax authorities. DorHob has the right to charge your authorized card the full amount stipulated in these Terms of Service, without regard to any such deductions or withholdings that may be required.

You are solely responsible for paying all applicable taxes and fees arising from all sales made through your DorHob store.

You must display your accurate location in the DorHob store's admin menu. If your jurisdiction changes, you must update your location in the admin menu promptly.

DorHob does not offer refunds.

DorHob reserves the right to launch promotional activities from time to time, such as issuing coupons to customers who meet certain conditions. The specific promotional scheme will be subject to the activity rules or coupon usage instructions announced at that time. Before participating in the activity, you must carefully read the activity rules or usage instructions and agree to be bound by them. Participating in the corresponding activity or using the coupon means that you have agreed to and accepted the corresponding activity rules and usage instructions. DorHob will interpret the rules of promotional activities in accordance with laws and regulations.

All offers are non-transferable, non-refundable, and cannot be combined with other offers. They expire immediately upon use, and offers will not be refunded in the event of a payment error.

You accept and agree that all promotional offers are special offers provided by DorHob in addition to the normal service prices. DorHob may initiate, modify, withdraw, or cancel promotional offers at any time and for any reason, effective immediately upon notification from DorHob. Notifications are not retroactive and will not affect any previously enjoyed benefits.

 

  1. Cancellation and Termination

You can cancel your account and terminate the Terms of Service at any time by sending an email to service@DorHob.com , and then follow the specific instructions in the reply email from DorHob.

If either party terminates the service for any reason:

DorHob will cease providing services to you, and you will no longer be able to access your account.

Unless otherwise provided in the Terms of Service, you are not entitled to a pro rata or otherwise refund of any fees.

Any outstanding payments you owe to DorHob due to your use of DorHob services prior to the termination effective date will be due immediately and must be paid in full.

Your DorHob store will be shut down and taken offline.

After the service is terminated, you will need to handle all matters related to the domain name with your domain name provider.

On the date of service termination, if you have any outstanding charges, you will receive a final bill via email. Once that bill is paid in full, we will not charge you any further fees.

We reserve the right to modify or supplement the Terms of Service, User Agreement, and Privacy Policy, and to modify or terminate the DorHob service and/or your account from time to time as needed to optimize services based on changes in laws and regulations. Termination will not affect any rights or obligations incurred prior to the termination date.
Modified terms will be announced on the platform. If you do not agree to the updated terms, you have the right to contact us to provide feedback before the effective date specified in the announcement. If you still disagree with the updated terms, you should cease using our services from the effective date specified in the announcement. The updated agreement will not be binding on you. If you continue to use our services after the updated agreement takes effect, you will be deemed to have agreed to the effective agreement.

Fraud: If we suspect you of any fraudulent activity (through judgment, settlement, insurance, escrow investigation or other means), DorHob may suspend or terminate your account, and such actions will not affect DorHob' ability to take any other remedies.

 

  1. Service and service fee modification

DorHob may modify its service fees after providing a 30-day notice period. DorHob may provide such notifications at any time by posting changes on the DorHob website (DorHob.com) or in the admin menu of your DorHob store.

DorHob reserves the right to modify or terminate the Service (or any part thereof) from time to time without notice (unless otherwise provided by applicable law).

DorHob will not be liable to you or any third party for any modification, price change, suspension or termination of the service.

 

  1. Third-party services

DorHob may from time to time recommend and provide you with access to or enable access to interfaces or website links of third-party software, applications (hereinafter referred to as "Applications"), products, and services (collectively, "Third-Party Services") for your consideration or use (including services offered through the DorHob App Store or Expert Marketplace). Such Third-Party Services are provided solely for convenience, and your purchase, access, or use of any such Third-Party Services constitutes a transaction between you and the respective Third-Party Service Provider (hereinafter referred to as "Third-Party Provider"). In addition to these Terms of Service, you also agree to comply with specific Additional Terms of Service applicable to services purchased from or provided by Third-Party Providers.

You assume all risks associated with using third-party services provided by the DorHob website. It is your responsibility to read the applicable terms and conditions and/or privacy policy before using such third-party services. In some cases, DorHob may receive a share of revenue from the service providers of third-party services recommended by DorHob or other third-party services you choose to use through the DorHob website.

We make no warranties or representations regarding third-party services. You acknowledge that DorHob has no control over third-party services and therefore assumes no responsibility for anyone using such services. Offering third-party services on the DorHob website (including the DorHob App Store or Expert Marketplace), integrating such third-party services with DorHob services, or enabling such third-party services does not constitute or imply DorHob's endorsement, authorization, recommendation, or affiliation with such services. DorHob does not guarantee the availability of third-party services, and you acknowledge that DorHob may, at its sole discretion, block access to any third-party service at any time without notice. DorHob will not be liable to anyone for suspending or disabling any third-party service. DorHob strongly recommends that you seek expert advice before using third-party services to ensure they meet your needs. Especially when assessing the correct tax rates you should charge your customers, tax calculators should be used for informational purposes only and should not replace independent tax advice.

If you install or enable third-party services and use them in conjunction with DorHob services while using this service, you authorize us to allow applicable third-party providers access to your data and other materials and to take necessary measures to ensure the smooth operation of interactions between third-party services and DorHob services. Any data exchange and other interactions between you and third-party providers are limited to your interactions with such third-party providers. DorHob is not liable for any disclosure, modification, or deletion of your data or other materials, nor for any loss or damage you suffer as a result of third-party services or third-party providers' access to your data or other materials. Google Maps is a third-party map service used in DorHob services. If you wish to use DorHob services, you must accept the Google Maps and Google Earth Corporate General Privacy Policy and Service Agreement, as well as any updates to the above terms from time to time. You will need to check these updated terms periodically.

You acknowledge and agree that: (i) by submitting a request for assistance or other information through DorHob Support, you consent to one or more third-party providers contacting you via the store owner's registered email address (or such other email address you provide) and applicable user email addresses; (ii) DorHob will receive all emails exchanged between you and the experts through the Expert Marketplace or in any reply email (each "Reply") issued directly or indirectly from the Expert Marketplace. Furthermore, you agree that DorHob has the right to provide and share your contact information and background information submitted through DorHob Support with third-party service providers. Third parties may need access to certain backend pages of your DorHob store. You can choose which pages third parties are allowed to access.

Your relationship with any third-party service provider is strictly limited to the relationship between you and the third-party service provider. DorHob has no obligation to intervene in any disputes that arise between you and the third-party service provider.

Under no circumstances shall DorHob be liable for any direct, indirect, incidental, special, punitive, or other damages arising out of or relating to any third-party services or your partnership with a third-party provider. These limitations of liability shall apply even if DorHob has been advised of the possibility of such damages. The foregoing limitations shall apply to the fullest extent permitted by applicable law.

If you have any conflict of interest with a third-party provider while using third-party services, you indemnify and hold harmless DorHob and its affiliates, partners, officers, directors, agents, employees and suppliers from any third-party suits and claims for damages, and agree to indemnify us for any related litigation costs and damages, including reasonable attorneys’ fees.

 

  1. Beta Version Service

DorHob may, at its sole discretion, invite you to try pre-release or beta features that are still under development and not yet available to all merchants (hereinafter referred to as "Beta Services"). To use the Beta Services, you must comply with additional terms and conditions, which DorHob will provide to you prior to your use of the Beta Services. All conversations and materials related to such Beta Services will be considered DorHob' confidential information and will be subject to the confidentiality provisions of this Agreement. Without prejudice to the foregoing generality, you agree not to make any public statements or otherwise disclose your participation in the Beta Services without DorHob' prior written consent. DorHob makes no representations or warranties regarding the functionality of the Beta Services. DorHob may discontinue the Beta Services at any time at its sole discretion. DorHob shall not be liable for any injury or damage arising out of or related to the Beta Services. The Beta Services may function differently from the final version. DorHob may, at its sole discretion, change or not release the final or commercial version of the Beta Services.

 

  1. Feedback

DorHob welcomes any ideas or suggestions regarding improvements or additions to its services. Under no circumstances will DorHob be obligated to keep confidential or provide any compensation to you for any ideas, suggestions, or related materials you disclose to DorHob, or your evaluations of DorHob services, third-party services, or third-party service providers (collectively, “Feedback”). By providing feedback to DorHob (whether submitted directly to DorHob or posted on any DorHob-hosted forum or owned page), you waive all rights to the content of your feedback, and DorHob has the right to freely implement and use your feedback, or feedback modified by DorHob, as needed without your or any third party's permission. Any comments you submit to DorHob regarding third-party services or third-party service providers must be the most accurate to your knowledge and must not be illegal, obscene, threatening, defamatory, privacy-invading, intellectual property-infringing, or otherwise harmful or objectionable to third parties. DorHob reserves the right (but not the obligation) to delete or edit feedback regarding third-party services or third-party service providers, and DorHob has no obligation to periodically review published feedback.

 

  1. DMCA Notification and Removal Procedure

DorHob supports intellectual property protection and requires merchants using DorHob services to do the same. Our policy requires us to respond to all notifications of alleged copyright infringement. If someone believes one of our merchants has infringed their intellectual property, they can send a DMCA notice to DorHob's designated agent using our form. Upon receiving a DMCA notice, we may remove or block access to allegedly infringing material. If a merchant objects to the complaint after receiving a removal notice, they can respond with a defense notice using our form. The original complainant may seek a court order to restrict the merchant from engaging in infringing activities within 14 business days of receiving the defense notice; otherwise, we will reinstate the material.   1. Third-party rights

Except for DorHob and its affiliates, DorHob users, or anyone accessing DorHob services pursuant to these Terms of Service, no person or entity not a party to these Terms of Service has the authority to enforce any provision of these Terms of Service, regardless of whether such person or entity has been identified by name as a member of a particular group or as meeting the characteristics of a particular description. For the avoidance of ambiguity, this shall not affect any permitted assignee or the rights of such assignee.

 

  1. Privacy and Data Protection

DorHob takes the protection of your and your customers' personal information ("Personal Information") very seriously. By using DorHob services, you acknowledge and agree that DorHob will comply with the Privacy Policy when collecting, using, and disclosing this Personal Information.

Furthermore, if: (a) you do business in the European Economic Area (EEA); (b) you provide goods or services to customers in the EEA; or (c) you must comply with the requirements of the EU General Data Protection Regulation, then DorHob’ collection and use of any European resident’s personal information is subject to our Data Processing Annex.
